STATEMENT ON RAILROAD JURISDICTION

publicnoticeThe parish passed a resolution in 2010 strongly requesting all railroad/railway companies operating in the parish acknowledge that "it shall be unlawful for any train, railroad car, or equipment, or engine to obstruct vehicular traffic at a public highway railroad grade crossing for a period in excess of twenty (20) consecutive minutes…”

However, this is neither binding nor enforceable by St. Charles Parish. Railroads are considered federal property and the courts have determined that only Congress has the legal authority to regulate railroad activities. There is no enforceable law, rule or regulation that the parish is aware of that limits the time a railroad can block a crossing.
